Personal Data Protection Notice (PDPA)

This Notice explains how LWA Digital, operated by LWA Digital Academy (Registration No. 202603255156 (PG0593844-D)) (“we”, “us”), collects, uses and protects your personal data in accordance with the Personal Data Protection Act 2010 of Malaysia, as amended by the Personal Data Protection (Amendment) Act 2024 (“PDPA”). It is issued in English and Bahasa Malaysia; in case of any inconsistency, the English version prevails.

1. Personal data we collect

Depending on how you deal with us, we may collect:

  • Contact details: your name, company name, email address, phone / WhatsApp number.
  • Enquiry details: the services you are interested in and the message you send us.
  • Project and billing details: information needed to quote, deliver and invoice our services, including content and access details you provide for your website, domain or hosting.
  • Training details: participant names and details required for attendance records and, where applicable, HRD Corp grant applications and claims.
  • Technical data: your IP address and basic browser information recorded when you use our website or submit our enquiry form.

2. How we collect it

We collect personal data directly from you — through our enquiry form, WhatsApp, email, phone, meetings and agreements — and, for training, from your employer when it registers participants.

3. Why we use it

  • To respond to your enquiry and prepare quotations and recommendations.
  • To deliver our services, manage projects and provide support and maintenance.
  • To invoice and keep accounting records.
  • To organise training, keep attendance records and process HRD Corp grants and claims.
  • To communicate with you about your project or account.
  • To comply with the law and protect our legal rights.
  • To send you news or offers only if you agree; you can opt out at any time.

4. Is providing your data obligatory?

Your name, a way to contact you (email or phone) and your message are required for us to respond to an enquiry. Other information is voluntary. If you do not provide required information, we may be unable to respond to you or provide our services.

5. Who we may share it with

We do not sell your personal data. We only share it where needed for the purposes above, with:

  • Service providers who help us run our business, such as web hosting, email, domain registries and registrars, cloud storage and payment providers.
  • HRD Corp, for training grant applications and claims.
  • Our professional advisers, such as accountants, auditors and lawyers.
  • Government or regulatory authorities when required by law.

Some of these providers may store data outside Malaysia. Where this happens, we take reasonable steps to ensure your data is protected as required by the PDPA.

6. How we protect it

We take practical security measures to protect personal data from loss, misuse, unauthorised access, change or disclosure, and we require our service providers to do the same. If a personal data breach occurs, we will handle it and notify the Personal Data Protection Commissioner and affected individuals as required by the PDPA.

7. How long we keep it

We keep personal data only for as long as needed for the purposes it was collected for, or as required by law (for example, accounting and tax records). After that, we delete or anonymise it securely.

8. Your rights

Subject to the PDPA, you may:

  • Access the personal data we hold about you.
  • Correct personal data that is inaccurate, incomplete or out of date.
  • Withdraw your consent or ask us to limit how we process your data.
  • Ask us to transmit your data to another organisation (data portability), where applicable.
  • Opt out of marketing at any time.

Send your request in writing to info@lwadigital.com.my. We may need to verify your identity and will respond within the period required by the PDPA.
